Official Rules
1. ELIGIBILITY: The Sony – Shoot For The FIFA World Cup™ Contest (“Contest” or “Promotion”) is only open to legal residents of the 50 United States or the District of Columbia who are at least 18 years of age - or the age of majority in his or her state of residence whichever is older - at the time of entry (“Entrant”). Employees, officers and directors of Sony Corporation of America (“Sponsor” or “Sony“), the Fédération Internationale de Football Association (“FIFA”), sports teams associated with FIFA, and Intersport, Inc. (“Administrator” or “Intersport”), their respective parent, affiliated and subsidiary companies, advertising and promotion agencies, web masters and web suppliers and persons engaged in the development of Promotion materials, and members of the immediate family (parents, siblings, children and spouse, wherever they reside) or household members (whether or not related) of such employees, officers and directors are not eligible. By participating, you agree to these Official Rules and all decisions of Sponsor and/or Administrator, an independent judging and administration organization, which are final and binding in all respects. Void where prohibited.
2. CONTEST PERIOD: The Contest will begin on August 24, 2009 at 12:00:01 A.M. Eastern Daylight Savings Time (ET) and end on October 18, 2009 at 11:59:59 P.M. (ET) (“Contest Period”). The Contest computer is the official time keeping device for the Contest.
3. CONTEST PARTICIPATION:
A. Contest Overview: This is a photo and video Contest. To participate the Entrant must take a still digital photograph (“photo”) or record a video (“video”) of a child under the age of 18 years of age (“Child”) depicting soccer content and expressing the excitement, skill, emotion, enthusiasm and/or intensity of the Child playing or practicing soccer. The photo must be a .jpg and cannot be larger than 200kb. The video must be in one of the following formats: 3gp, 3gp2, 3gpp, 3gpp2, asf, avi, dv, flv, mod, mov, movieclip, mp4, mpeg, mpg, mts, qt, or wmv; cannot be larger than 200MB; and cannot contain any animation, speed modification (slow motion or speed-up) or like elements. The video may include sound but should not contain commercial music. There will be 4 categories of entries: (i) photos featuring males, (ii) photos featuring females, (iii) videos featuring males, and (iv) videos featuring females.
B. Submission of A Photo Or A Video: To submit a photo or video (“Entry”) access www.sony.com/fifa (“Web site”), click on the icon, banner, or text links to be taken to the Contest registration page, and complete the required registration information fields, specifically, Entrant’s Name (first and last), Entrant’s Username (for display on site), Entrant’s Email Address, Home Address, City, State, and Zip.
You must also click on the check box confirming that you have read, understand, and agree to these Official Rules. When you have completed the registration information and signified that you have read, understand and agree to these Official Rules, follow the directions to upload your Entry, attach necessary release(s) and click on the Submit button. When your Entry is received (including necessary releases) and recorded during the Contest Period you will receive 1 Entry into the Contest in the category designated when you registered.
C. Entry Parameters: The Entry must be taken by the Entrant, and must clearly feature and focus on the Child. To the extent any person in the Entry is recognizable (as solely determined by the Administrator and/or the Sponsor) a Release will be required as set forth in Rule 3E from each such recognizable person or their respective parent or legal guardian if such person is a minor in their jurisdiction of residence. The Entry: (i) must be the original and sole creation of the Entrant, and all right, title and interest including but not limited to the copyright and moral rights in any Entry must be owned solely by the Entrant, (ii) must not have been submitted in any other competition, (iii) must not have been published in any other medium/forum, (iv) must not infringe upon any third party’s rights, including but not limited to, copyright, patent or trademarks/tradenames/logos, or rights of privacy or publicity, or contain material that is or may be considered defamatory, slanderous or libelous, or portray or depict any person, product or entity in a false light, (v) must not violate any law, rule or regulation, (vi) must not contain any virus, bugs, or other deleterious material, and (vii) must not, for example, without limitation, contain, profanity, nudity, defamatory statements, words or symbols widely considered offensive to individuals of any certain race, ethnicity, religious, sexual orientation or socioeconomic groups, threats to any person, place, business, group or world peace; and each Entrant warrants and represents that his/her Entry complies with all of those conditions.
Entries cannot contain, among other things, the trademark, tradename or logo of any third party or entity or product (including but not limited to the trademark, tradename or logo of any business or product competitive with Sponsor or any Sponsor product). Further, the Entry cannot contain any material that is created by a third party and subject to copyright protection such as music or video clips. Any non-complying Entry with any of the above will be subject to disqualification. Further, Sponsor may disqualify any Entry which it deems, in its sole opinion, inappropriate for publication (including but not limited to posting on the Web site) in connection with the Contest.
D. Contest Entry Uses: By entering, each Entrant grants permission for the use of his/her Entry, and his/her name, and the First name and Last Initial of the name of the Child and any other person(s) depicted in Entry to be posted on the Internet and Web site or any web site in connection with this Contest, and in the advertising, promotion, and publicity of the Contest, and otherwise, as stated in these Official Rules (as solely determined by Sponsor); and each Entrant warrants and represents that he/she has all right and authority to grant such permission. Notwithstanding anything to the contrary, however, there is no obligation of the Sponsor or any other person or entity to post or make any use of the Entry.
E. Entry Releases:
(i) Should an Entry include person(s) who are at least 18 years of age or the age of majority in that person’s jurisdiction of residence, whichever is older and any of those person(s) are recognizable, a Release from those person(s) must be executed by each such person and a true scanned copy of the executed Release must be uploaded with the Entry. Should the Administrator and/or the Sponsor determine, in either of their sole opinions, that an Entry includes person(s) stated herein who are recognizable, and a Release for each person was not included with the Entry, the Entry may be disqualified, or, the Administrator and/or the Sponsor may notify the Entrant of the requirement for the Release. If the Release is not received within the time stated in the notice the Entry may be disqualified. Any such notice will be sent to the email address of the Entrant provided for Contest Registration. The only form of Release that will be accepted must be downloaded and printed from here.
(ii) Should an Entry include person(s) under the age of majority in that person‘s jurisdiction of residence and any of those person(s) are recognizable (including, but not limited to, the Child), a Release from the parent or legal guardian of Child and each other minor person must be executed by the parent or legal guardian of each such person on behalf of himself/herself and the person, and a true scanned copy of the executed Release must be uploaded with the Entry. Further, should the Administrator and/or the Sponsor determine, in either of their sole opinions, that an Entry includes person(s) stated herein who are recognizable, and a Release for each such person (signed by their legal guardian) was not included with the Entry, the Entry may be disqualified, or, the Administrator and/or the Sponsor may notify the Entrant of the requirement for the Release. If the Release is not received within the time stated in the notice the Entry may be disqualified. Any such notice will be sent to the email address of the Entrant provided for Contest Registration. The only form of Release that will be accepted for persons under the age of majority must be downloaded and printed from here.
F. Additional Restrictions: There is no limit on the number of Entries per Entrant but there is a limit of one prize per Entrant for the entire Contest. Once an Entry is submitted, it cannot be changed, altered, or modified. Entries, when received and recorded by the Contest computer, become the sole property of Sponsor and will not be acknowledged or returned. No questions relating to the Contest will be accepted, acknowledged or answered. No form of entry other than as stated in these Official Rules will be accepted. Entries that do not meet the requirements of these Official Rules will be disqualified. It is the sole responsibility of the Entrant to advise of any change in his or her email address by sending a notice of such change to support@shootforthefifaworldcup.com
4. Judging/Winning:
A. Judging: For each category stated in Rule 3A, above, all eligible Entries received and recorded during the Contest Period will be judged by a panel of at least 3 judges who are sports, soccer, and/or sports graphic industry professionals selected by the Sponsor. Eligible Entries will be judged by the panel of judges based on the following criteria: (a) 50 points available for depiction of soccer content, (b) 50 points available for expressing the excitement, skill, enthusiasm, emotion and/or intensity of the Child playing or practicing soccer and (c) 50 points available for the quality of the photo or video technical execution.
The Entrants who have submitted an Entry that scores the highest in each category will be deemed Grand Prize potential winners for their respective categories. The Entrants whose Entries score the next highest in each category will be deemed First Prize potential winners for their respective categories. The Entrants whose Entries score the next highest in each category will be deemed Second Prize potential winners for their respective categories. The Entrants whose Entries score the next highest in each category will be deemed Third Prize potential winners for their respective categories. In case of a tie, the Entry with the highest score for the “expressing the excitement, skill, enthusiasm and/or intensity of the Child playing or practicing soccer” criterion will be deemed the tie winner. If a tie continues a new judge, specifically, Brian McBride (or another soccer player selected by Sponsor) will be selected who will re-judge the tied Entries based on the original criteria. Potential prize winners will be notified by email, overnight mail or by such other method as determined by Sponsor on or about October 25, 2009.
5. Prizes/Prize Values:
4 Grand Prizes (1 per category): The Grand Prize is a trip to attend a game at the 2010 FIFA World Cup for the winning Entrant (“winner”) and Entrant’s guest (“winner’s guest”). The winner and the winner’s guest will receive round trip coach air travel from the airport nearest winner’s U.S. residence to a destination city in South Africa, 3-night/4-day accommodations (one standard double occupancy room), breakfast, lunch, and dinner (as selected by Sponsor) during stay in South Africa, and 2 tickets to a soccer game selected by Sponsor. Should winner’s guest be a child between the ages of 13 and 17 at the time of the grand prize trip, who meets the requirements of Sponsor and/or FIFA, the winner’s guest may also have the opportunity to be an official FIFA Flag Bearer prior to a soccer game (the particular game to be solely determined by Sponsor), and receive a FIFA Flag Bearer uniform. Approximate Retail Value (“ARV”) $10,000. Actual value will depend on the final itinerary, and any difference between the stated and the actual value will not be awarded. Travel must be taken on dates and itinerary determined by Sponsor. Once travel is booked it cannot be changed without the express consent of Sponsor which may be denied for any reason whatsoever. Travel/accommodations and transportation are subject to change, availability, and restrictions and are at the sole discretion of the Sponsor. Black-out dates/times may apply. All gratuities, in-room charges, travel expenses, transfers, taxes, and all other expenses not specified are the sole responsibility of the winner. Winner and guest must travel on the same itinerary, must comply with all security requirements and are solely responsible for obtaining their respective travel documents such as passports, visas, and proof of current vaccinations (all as may be required by law); and it is winner’s sole responsibility to assure the guest’s compliance with these responsibilities. Sponsor is not liable for delays, cancellations, or unforeseen events related to the prize.
4 First Prizes (1 per category): a Sony HDR-CX100 Handycam® camcorder, Manufacturer’s Suggested Retail Price (MSRP) $599.99
4 Second Prizes (1 per category): a Sony DSLR-A230L alpha DSLR (MSRP) $549.99.
4 Third Prizes (1 per category): a Sony DSC-T90 Cyber-shot® digital camera (MSRP) $299.99.
6. Prize Restrictions: If prize winner cannot accept a prize as stated, the prize may be forfeited in its entirety and awarded to an alternate winner. No substitution, cash redemption or transfer of prize is permitted, but Sponsor reserves the right to substitute a prize, or portion of a prize, with a prize (or portion) of equal or greater value, if an advertised prize or portion thereof becomes unavailable for any reason. Notwithstanding the forgoing, a potential prize winner may transfer his/her prize but only to a member of the potential winner’s immediate family (parent, sibling, or spouse, wherever they reside – provided they are over the age of majority), provided, such transfer is authorized in writing by Sponsor prior to the transfer. Such authorization may be granted or withheld in Sponsor’s sole discretion for any reason whatsoever. Any request for transfer of a prize must be made in writing, must identify the person to whom the proposed transfer is to be made and the relationship of the potential winner to that person, and must be included in the same envelope that contains the return of the potential winner’s Affidavit of Eligibility and Releases, stated below. The potential winners may be required to complete, sign and return an Affidavit of Eligibility, a Liability Release, and where lawful a Publicity Release within seven (7) days of date of notification for themselves and their guest – for grand prize winners. If documents, including the original executed Release for third parties stated in Rule 3E, above, are not returned timely, or if the prize notification or prize is returned as non-deliverable, or if the potential winner or guest is found to be ineligible or otherwise not in compliance with these Official Rules, prize will be forfeited and the other prize winners in the category will be elevated with a new third place prize winner selected based upon the scoring criteria set forth in these Rules. The parent or legal guardian of a Grand Prize winner’s guest must complete, sign and return a Liability Release and where lawful a Publicity Release both on behalf of himself/herself and the guest prior to the issuance of travel documents. Once the guest is determined the guest cannot be changed without the express written consent of the Sponsor which may be withheld for any reason. The winner will be solely responsible for the behavior of his/her guest. Should a winner’s guest engage in behavior that (as solely determined by Sponsor) is obnoxious, threatening, illegal or that is intended to annoy, abuse, threaten, harm or harass any other person Sponsor reserves the right to terminate the winner’s trip early, in whole or in part, and escort the winner and his or her guest to the return airport with no further compensation, and no liability. If there are an insufficient number of Entries in any category to award all of the prizes for that category, those prizes may not be awarded. All federal, state and local taxes are the sole responsibility of the winner.
7. Conditions and Limitations: By participating in this Contest, Entrants agree to release and hold harmless Sponsor, Administrator, FIFA, the Entry judges, their respective parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors and assigns (collectively and individually, "Releasees") from any and all actions, claims, injury, loss or damage (whether due to negligence or otherwise) to person(s), including death, or property, or breach or failure of any representation or warranty, or infringement upon any third party’s rights, (including but not limited to, copyright, patent or trademarks/tradenames/logos, or rights of privacy or publicity, or inclusion of material that is or may be considered defamatory, slanderous or libelous, or portray or depict any person, product or entity in a false light) arising in any manner, directly or indirectly, in whole or in part from participation in this Contest, or any Contest-related or travel-related activity, and/or acceptance, possession, misuse or use of any prize(s). By accepting the prize, each winner consents (and agrees to confirm that consent in writing upon request) to Sponsor and those acting pursuant to the authority of Sponsor, the rights , in perpetuity, to the use of winner’s name, voice, photo, picture, and likeness, and agrees to secure the rights to the use of the same for the Child and any others depicted in Entry, and to use Entry, (and notwithstanding anything to the contrary in these Official Rules, grants a non-exclusive license for the use of the Entry which may be edited, modified, altered, changed, used alone, together or with other works, acts or content and/or used in composite form, with or without comment or commentary, all as solely determined by Sponsor) at any time or times in all media now known or hereafter discovered or devised, worldwide, including on the Internet and World Wide Web, for advertising, commercial, trade and promotional purposes, without additional compensation unless prohibited by law, and without notice, review or approval. Each winner irrevocably sells, assigns and transfers to Sponsor all of winner’s right, title and interest in and to winner’s Entry, including but not limited to all copyright and trademark rights, and waives all moral rights in favor of Sponsor, which winner may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Upon request of Sponsor, each winner shall execute and deliver such additional instrument of sale, transfer and assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the subject Entry and of the copyrights, and trademarks transferred, and all moral rights waived. Should Sponsor fail to request the said additional instrument of sale, transfer and assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request that instrument, and the stated winner agrees to honor and comply with such request.
8. Limitations of Liability: Releasees are not responsible for lost, late, incomplete, stolen, misdirected, postage due, separated or illegible, mail, Entries, or email; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/Web site/use net accessibility, availability, or traffic congestion, or any technical error, or any program or programming error or failure, or unauthorized human intervention, or the incorrect or inaccurate capture of registration, Entry, or other information, or the failure to capture, or loss of, any such information. Releasees are not responsible for any incorrect or inaccurate information, whether caused by Web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Promotion and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to, or use of, the Web site. Releasees are not responsible for errors of any kind whether human, mechanical, electronic, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of Entries, the announcement of the prize, winner or in any Contest-related materials. The right is reserved by Sponsor its sole discretion, to disqualify any individual found, at its sole discretion, to be tampering with the entry process or the operation of the Promotion or Web site, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or third party entry methods will void all such entries by such methods, and disqualify any participant using such methods. Releasees are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion or downloading or printing materials from the Web site or use of the Web site. If, for any reason, the Promotion is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and/or proceed with the Promotion in a manner deemed fair and appropriate by Sponsor; and select winners from Entries received prior to the action taken or as deemed fair and appropriate by Sponsor. In case of dispute, the authorized subscriber of the email account used to enter the Promotion at the actual time of entry will be deemed to be the Entrant, and must comply with these Official Rules. The authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet Access Provider, on-line service provider, or other organization, which is responsible for assigning email addresses.
9. Entrant's Personal Information: Information collected from Entrant is subject to the Sponsor’s Privacy Policy and by using the Web site you will be subject to the Web site’s Terms of Use. 10. Arbitration/Choice Of Law: Except where prohibited, Entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prize awarded, or the determination of any winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Releasees in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without regard for conflicts of law doctrine of any jurisdiction, and all proceedings shall take place in the City of Chicago, in the State of Illinois.
11. Winner List: For the names of the winners mail a self-addressed stamped envelope to Sony – Shoot For The FIFA World Cup™ Contest-Winners List, Intersport, Inc., 20 W. Kinzie Ste. 1600, Chicago, IL 60654, for receipt by 11/25/09. The names of the winners may also be posted on the Web site.
12. Number of Entries: Because this is a new contest, the number of entries cannot be estimated.
